A building firm has been prosecuted following construction work to refurbish a pub where the company failed to obtain results of a required asbestos demolition survey and commenced work.
An asbestos survey conducted (post works) found asbestos materials in debris. Some materials of the structure were marked as containing asbestos. Asbestos materials form the work were left laying outside the building.
The work required an asbestos licenced contractor to remove the asbestos and deploy appropriate health and safety control measures.
The company was prosecuted under The Control of Asbestos Regulations 2012 (Regulation 16)
Duty to prevent or reduce the spread of asbestos
Every employer must prevent or, where this is not reasonably practicable, reduce to the lowest level reasonably practicable the spread of asbestos from any place where work under the employer’s control is carried out. The company was further prosecuted for failings under Regulations 5 and 8
